Employer Terms of Service
These Employer Terms of Service ("Employer Terms") apply to all employers, recruiters, staffing agencies, and other hiring organizations ("Employer," "you," or "your") that access or use AxoCareers' job posting, recruiting, or employer services. These Employer Terms are incorporated into and made part of the AxoCareers Terms of Service. Capitalized terms not defined here have the meaning given in the Master Terms.
1. Accurate Company Identity
You represent and warrant that: (a) your company name, legal entity name, contact information, and any other account details are accurate and not misleading; (b) you are authorized to post jobs on behalf of the entity you represent; and (c) you will promptly update your account if your information changes. Posting jobs on behalf of an employer without authorization is prohibited.
2. Accurate Job Descriptions
All job postings must accurately and completely describe the role, requirements, responsibilities, and compensation. You may not post speculative, misleading, or materially inaccurate job descriptions. If an open position is filled or withdrawn, you must remove or update the listing promptly.
3. Recruiter and Staffing Agency Disclosure
Recruiters and staffing agencies must clearly disclose that they are acting as a recruiter or staffing intermediary in each posting where applicable. You must not imply that a posting is a direct-employer opportunity when you are acting as a third-party recruiter without authorization from the direct employer.
4. Authorization to Post
You represent that you are authorized to post each job listing on behalf of the hiring organization named in the listing. If you are a recruiter or staffing agency, you warrant that you have the client's permission to advertise the role. Unauthorized posting of another organization's jobs is prohibited and may result in removal and account suspension.
5. Compensation and Pay Transparency
Employer acknowledges that federal, state, and local laws may require job postings to disclose compensation ranges, pay scales, commission structure, bonus eligibility, benefits, equity, or other compensation-related information. Employer is solely responsible for determining whether a posting triggers such requirements and for providing complete and legally compliant disclosures. AxoCareers may, but is not obligated to, request revisions to, reject, suspend, edit, or remove any posting that appears non-compliant. AxoCareers assumes no liability for Employer's failure to provide required compensation or benefits disclosures. Employer shall defend, indemnify, and hold harmless AxoCareers and its affiliates, officers, employees, and agents from and against any claim, investigation, demand, penalty, fine, cost, or expense arising out of or related to Employer's non-compliant job posting disclosures.
Before submitting a paid job post, you will be asked to attest that your posting includes compensation and benefits disclosures required by applicable law.
6. Prohibited Postings
You may not post jobs that:
- Are fraudulent, deceptive, or for non-existent or purely speculative positions
- Require upfront payment, deposits, or fees from candidates
- Involve multi-level marketing (MLM), pyramid structures, or commission-only roles where compensation structure is not clearly disclosed
- Violate federal, state, or local employment, anti-discrimination, or labor law
- Discriminate based on race, color, religion, national origin, sex, age, disability, genetic information, or any other legally protected characteristic
- Are intended to harvest resumes or contact information for purposes other than legitimate hiring
- Were scraped or copied from another platform without authorization
- Impersonate another employer, company, or hiring organization
- Are designed to collect sensitive personal information (SSN, financial account numbers, passport numbers) from candidates prior to any offer of employment
7. Ghost Jobs, Feed Gaming, and Unauthorized Aggregation
You shall not post, refresh, or repost a materially identical job within fourteen (14) days for the primary purpose of manipulating search placement, freshness indicators, or candidate traffic. You shall not post evergreen, speculative, pipeline-building, or otherwise misleading vacancies unless the listing clearly and conspicuously states that the role is not tied to an immediate opening. You shall not submit to AxoCareers any job obtained through scraping, copying, unauthorized syndication, or reformatting from another website, ATS, platform, or feed without written authorization from the rights holder.
8. External Application Links
You are solely responsible for the accuracy, lawfulness, security, and operability of any external application link, ATS endpoint, career-site URL, or off-platform workflow used in connection with a posting. You warrant that each application path directs candidates only to a page controlled by you or your authorized service provider. AxoCareers may display link-status indicators for convenience only and does not guarantee that any external application was completed, received, or reviewed.
Broken external links, incorrect employer URLs, expired ATS pages, or employer-controlled application issues do not automatically qualify for a refund. See our Refund Policy.
9. No Resume Harvesting
You may not post jobs for the primary purpose of collecting resumes, contact information, or work history without a legitimate immediate or near-term hiring intent. Candidate data submitted through AxoCareers may only be used for legitimate recruiting and hiring activities for the specific role to which the candidate applied.
10. Candidate Data Use Restrictions
You may use candidate information submitted through AxoCareers solely for evaluating candidates for the position to which they applied. You may not sell, license, transfer, or use candidate data for any purpose unrelated to that application. You are solely responsible for compliance with all applicable privacy, anti-discrimination, and employment laws with respect to candidate data in your possession.
11. Healthcare Credentialing and Exclusion-Screening Notice
CRITICAL HEALTHCARE COMPLIANCE NOTICE: Unless AxoCareers expressly agrees otherwise in a signed writing, AxoCareers does not perform primary source verification of professional licenses, board certifications, training, education, employment history, DEA registration, sanctions status, OIG/LEIE checks, state Medicaid exclusion checks, NPDB queries, clinical privileging, immigration/work authorization verification, or background checks. Employer bears sole responsibility for all credentialing, privileging, sanctions screening, exclusion screening, license verification, background investigations, and other pre-employment or pre-engagement checks required for any healthcare, clinical, patient-facing, regulated, or credentialed role.
For clinical or regulated roles, you will be asked to acknowledge this notice before publishing your job posting.
12. AI-Assisted Hiring Compliance
AxoCareers may offer AI-Assisted Features that generate recommendations, rankings, summaries, labels, scores, or other outputs relating to job postings or candidates. As between AxoCareers and Employer, Employer is solely responsible for determining whether Employer's use of any AxoCareers feature triggers any obligation under applicable law, including obligations relating to notice, consent, accommodation, alternative processes, human review, recordkeeping, impact assessment, bias testing, validation, audit, or public disclosure. Employer shall not use any AxoCareers output as the sole basis for an employment decision and shall ensure that a qualified human reviewer retains final decision-making authority over hiring, screening, interview selection, advancement, and rejection decisions.
See our AI-Assisted Features Notice for more information.
13. Employer Responsibility for Applicable Law
You are solely responsible for compliance with all applicable federal, state, and local labor, employment, wage, immigration, credentialing, healthcare, privacy, and anti-discrimination laws in connection with your use of AxoCareers and your hiring activities. AxoCareers does not provide legal, HR, credentialing, or compliance advice.
14. Job Approval, Denial, Removal, and Moderation
AxoCareers reserves the right to review, approve, reject, edit, suppress, expire, or remove any job posting at its sole discretion, including without notice, for any reason or no reason. AxoCareers may notify you of the reason for rejection or removal at its discretion. Removal or rejection of a job posting for policy violations, fraud, or other prohibited conduct does not entitle you to a refund. See our Refund Policy.
15. Employer Indemnification
You agree to defend, indemnify, and hold harmless AxoCareers and its affiliates, officers, directors, employees, contractors, and agents from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your job postings; (b) your hiring practices; (c) your use of candidate data; (d) your violation of these Employer Terms or the Master Terms; (e) your violation of applicable law; or (f) any employment-related claim brought by or on behalf of an applicant or employee in connection with your use of AxoCareers.
16. Refund and Cancellation
Paid job posting fees and other employer service fees are governed by our Refund and Cancellation Policy, which is incorporated into these Employer Terms by reference. By purchasing any paid service, you agree to that policy.
